REPUBLIC OF THE PHILIPPINES……...) s. s. CITY OF ZAMBOANGA………………..) SWORN STATEMENT I, CASSANDRA S. DEL CASTILLO, married, of legal age and a resident of Blk. 01, Lot 15, Green Heights Subdivion, San Roque, Zamboanga City, after having been sworn to in accordance with law, hereby depose and state that: 1. I am the legal wife of MIGUEL C. DEL CASTILLO having married him on 15 July 2013 solemnized at the Cathedral of Immaculate Conception in Zamboanga City. An authenticated copy of our Marriage Contract is hereto attached as Annex “A”; 2. After said blissful ceremony, everything went on smoothly and happily in our married life even without any issue, except for the occasional misunderstandings of husband and wife which is certainly part of one’s married life; 3. Until on January 07, 2014, MIGUEL C. DEL CASTILLO, the respondent, as project engineer by profession, was invited for a project proposal. In lieu thereof, he conducted pre-planning and resource forecasting for engineering and technical activites at Kabasalan, Zamboanga Sibugay; 4. Until sometime on January 2014, I observed my husband MIGUEL often disappears from our residence for a week with no notice or information of his location. As his legal wife, I tried to locate him by calling his cell phone but no to avail; 5. That after a week of disappearing, he comes home and when asked as to his whereabouts on those days he disappeared without notice, he would never tell a single detail and would just keep quite. I also observed that half of the quantities of his shirts, pants, and shoes were already missing. Repeatedly this scenario happened every time when he had his travel; 6. Because of all these unusual behavior of MIGUEL I began to doubt him of having an illicit affair with someone else; 7. A month later, I received a phone calls from our family friend, SPO1 CARLA G. CRISANTO, who temporarily assigned at Kabasalan, Zamboanga Sibugay, informing me that she allegedly saw my husband having an illicit affair with someone, but she did not tell me the name of the woman and instead informed me that my husband’s lover allegedly worked in a carinderia located just near the central police station in front of the construction site. A copy of the Affidavit of Witness is hereto attached as Annex “B”; 8. Having received such phone call, it dawned upon me that my husband once told me that somebody will be working as housemaid from Kabasalan, Zamboanga Sibugay. I confronted him regarding such phone calls I received but as expected he denied the same; 9. On February 05, 2014, when I arrived at home from my work as a Chief Nurse Officer (CNO) at Ciudad Medical Hospital, Zamboanga City, my husband brought and introduced JANE B. PILAPIL, as our housemaid. 10. Until on March 05, 2014 around 9 a.m., DELFIN SOLIVEN, the gardener, allegedly saw my husband entered Jane’s room. He heard some conversations like, “Sir..basig masakpan ta nila.. kato bitaw isang adlaw si Manang Fe nangutana nako kay nakit-an niya ka nisulod sako kwarto.”” Day, ako lagi bahala, ayaw paghuna-huna..hadlok na sila sako oi.” Despite what he had witnessed, he kept it as secret for fear that he will lose his job. A copy of the Affidavit of Witness is hereto attached as Annex “C” 11. A week thereafter when I arrived at home around seven (7 o’clock) in the evening, I noticed Manag Fe, the housekeeper, was not around. Then my husband told me

that she decided to leave for two (2) months. From then I don’t have any communication from Manang Fe; 12. Until sometime on June 05, 2014, I was surprised when Manang Fe (Marife Lacsamana) arrived and she hug me tightly while crying. Thereafter, she narrated to me what had happened before she leaves the house. She allegedly saw my husband and JANE B. PILAPIL, the housemaid, inside the latter’s room and heard some conversations as follows, “Sir, pirmi nalang ta gatago..basig makit-an ta ni Manang Fe ug Manong Delfin, naa baya sila sa gawas ra.” “Day, ayaw kabalaka oi…akong pahawaon si Manang Fe kay murag na observe na ko pirmi siya gaagi diri sa imong kwarto.” “ok mas maayo pa na pahawaon na….”. She allegedly force by my husband to leave the house the following day after such incident. A copy of the Affidavit of Witness is hereto attached as Annex “D” 13. Because of what I discovered from Manang Fe, I began to doubt him of having an illicit affair with JANE B. PILAPIL, the housemaid; 14. Until one night on July 14, 2014, while I had my safe and sound sleep, suddenly I was awaken by a strong winds. It’s around 12 midnight but still it’s raining outside. I have noticed that my husband was not on my side and I immediately went outside the room. As I about to step in on the second door, I heard some voices chatting inside Jane’s room but at first I can’t comprehend what they were talking about until I took some steps heading the door. Subsequently, I was surprised when I saw my husband inside the room. I could not help but to think something is wrong. When I saw JANE B. PILAPIL, the housemaid, she was lying on the bed as her blouse folded up as to half exposed her body while my husband was touching Jane’s abdomen; 15. Thereafter, I confronted my husband with JANE B. PILAPIL, the housemaid, about such alleged illicit affair, but as expected they denied the same; 16. In addition, it is most unlikely that JANE B. PILAPIL, the housemaid, had not been aware of my husband’s current status as a married man seeing as this love affair has been going on since January 2014 up to the present times. They have been meeting together secretly; 17. Based on the foregoing facts, I have logical reason to believe that the respondents have committed the crime of concubinage punishable under Article 334 of the Revised Penal Code. There is Concubinage, when a married man, such as my husband, who brought or allowed his mistress, such as JANE B. PILAPIL, not her wife to live in the conjugal dwelling. The paramour is also liable, since she is aware of his status as a married man, under the same law; 18. I am executing this sworn statement for the purpose of charging MIGUEL C. DEL CASTILLO, respondent, and JANE B. PILAPIL her paramour, for violating Article 334 of the Revised Penal Code which penalizes the crime of concubinage.
